Gattai, Minoli, Partners and a foreign credit institute in the recognition in Italy of a worldwide freezing order
The Firm, with a team composed of Partner Laura Ortali, Counsel Stefano Ferrero and Associates Alberto Panacci and Ottavia Fratton, has successfully advised the insolvency procedure of a foreign credit institute before the Court of Appeal of Naples, in the proceedings aimed at obtaining the recognition in Italy of a worldwide freezing order issued by the London High Court of Justice and the cancellation of the reservation made by the Land Registrar to the registration of such order.
The judgment stands out for it holds – pursuant to Regulation (EU) 1215/2012, applicable to this case ratione temporis – the validity of registration without reservations of an English worldwide freezing order in the Italian land registries, such as a domestic attachment of assets.
